Item 1.01 Entry into a Material Definitive Agreement
On September 9th, 2005, Advanced Power Technology, Inc. amended its wafer production and testing agreement with Infineon Technologies Austria AG. The agreement, for which volume and pricing are typically negotiated annually, is for the provision of foundry services to be performed by Infineon Technologies Austria AG. The contract is effective through June 30, 2006. A copy of the agreement is attached as Exhibit 10.37 of this report.
