A post-nuptial agreement is a contract that covers the division of assets as well as custody and parenting time in the event of divorce. It is similar to a pre-nuptial agreement, but is signed after the marriage takes place.

Recently, several sources have indicated that singer Beyonce and rapper Jay-Z have finalized a post-nuptial agreement, possibly in preparation for a forthcoming divorce. Hornberger says that other couples facing marital problems or considering divorce should take note.

“Whether or not a married couple has a high net-worth, it is often easier for couples to come to an agreement before divorce is imminent," Hornberger said. "Those facing marital problems should consider a post nuptial agreement now to protect themselves later."

Hornberger also claims that if and when the time for divorce does come, spouses will save themselves time, money and stress by having their post-nuptial agreement ready. “It’s a pro-active way to avoid lengthy, painful divorce litigation,” Hornberger said.  "When spouses reach an agreement ahead of time, it decreases the time and stress involved in divorce."

Although a post-nuptial agreement does not guarantee that a divorce will be dispute-free, it does offer the security that the essential issues have been agreed upon in a signed contract.

“An experienced divorce mediator or divorce lawyer can provide counsel to couples considering separation or divorce about how to best protect their assets as well as their peace of mind,” Hornberger said, adding that he recommends divorce mediation as an invaluable tool for couples that wish to avoid an acrimonious divorce.
