Fed courts reveal Bernie Sanders' private prosecution of political activist days before DNC debate

Hialeah, Jun 28, 2019 (Issuewire.com) - Just days before the first Democratic presidential primary debate in Miami, court documents with inculpatory evidence on Democratic presidential candidate Bernie Sanders and his campaign attorney was filed in a federal court in New Jersey last week.

The uniquely entitled "Gotcha Evidence" reveal a showing of clear and convincing evidence that Sen. Bernie Sanders' presidential campaign committee attorney secretly organized an arbitrary arrest, private prosecution, and political sabotage campaign against civil rights lobbyist Cary Lee Peterson, as an alternative to civil action, in early 2016 prior to Sanders losing the Democratic presidential primary election to former Secretary of State Hillary Clinton.

The Gotcha Evidence filed in SEC v. RVPlus, Inc. (3rd Cir. U.S. N.J. 2016) consisted of eight exhibits that support a 32-page legal brief, showing the preponderance of evidence (including 'who, when, what, why, and how'), that place the burden of derivative and alternative liability on Senator Sanders and his attorney Brad Deutsch of Garvey Schubert Barer, for using a pretext barred by collateral estoppel and "res judicata" to arrange and conspire an arbitrary arrest and private prosecution of the West Indian-American lobbyist- of which included a disorganized Sunday morning arrest by Customs and Border Protection and the FBI upon a flight arrival from Australia to San Francisco on March 13, 2016.

PRIVATE PROSECUTION & FIDEL CASTRO

In 1981, the U.S. Supreme Court removed the right to federal private prosecutions by private citizens in Leeke v. Timmerman. This also made it illegal for a private party or attorney to privately influence a government prosecutor or judge to file criminal charges or order for an arrest warrant on a person due to a civil dispute.

Former Cuban president Fidel Castro was scrutinized and sanctioned by the U.S. for totalitarianism that involved several malicious prosecutions of political activists who publicly expressed and unfavourable remarks about Castro.

Unlike the United States, where the civilian rights on freedom of speech on political views, due process, protection from cruel and unusual punishment, and trial by an impartial court are guaranteed under the U.S. Constitution, Cuba law limits freedom of expression, association, assembly, movement, and the press. Consequently, human rights organizations around the world have expressed concerns about the operation of due process and human rights abuses, including arbitrary arrest and imprisonment, and unfair trials. As a result of Castro's socialist monarchy, many Cubans had fled to the United States for refuge on civil liberties, not welcomed in Cuba.

GOTCHA EVIDENCE CONTRADICTS FAKE NEWS

Contrary to uncharged claims among the ad hominem controversy previously published by certain news sites, court records filed last week made showings of evidence (email dialogue) that in June 2015, Sanders' general counsel Brad Deutsch and the 'super PAC man' Cary Lee Peterson had resolved the matters in controversy confronted in Deutsch's cease-and-desist notice sent to Peterson's PAC. And, per Gotcha Evidence (docket entry "32-3"), Deutsch had no objections to the large donation made by actor Daniel "James Bond" Craig. Additionally, in July 2015, Deutsch's reply wishes Peterson well and gives his blessing on Craig's donation.

Ironically, Deutsch's comments made to the press after Peterson's arrest corroborate the remarks made later that year by an Ohio media broadcasting company owner who stated (twice in the same email) that someone at Garvey, Schubert Barer (rather than a federal prosecutor or judge) had 'filed federal charges' on Peterson. In this case, the Ohio man who made this shocking disclosure about his Deutsch's law firm is a mutual associate of Peterson.

SANDERS' UNSOUND & UNREASONABLE JUSTICE STRATEGIES

The Delaware federal judge in Peterson v. RVPlus stated that Peterson's criminal case in New Jersey and the civil suit in his courtroom "overlap."

(So, here's how things go south between Sanders and Peterson.) Before an Ohio court order for a subpoena of the bank records from RVPlus's attorney in November 2016, Deutsch's client "T.K." blamed Peterson for scamming his friend "Mike" out of $300,000, which was supposed to fund the purchase of the control share block of 'RVPL.'

Court records from recent filings and two other federal cases in Delaware and Third Circuit Court of Appeals show that the two men who purportedly sold the public shell company to Peterson never followed through with delivery of any corporate documents needed to successfully complete the transfer of control of management of the publicly traded shell company; thus Peterson's deal was merely a 'non-event' "in fieri", which made it impossible for him to be the 'CEO' or an acting principal with any genuine authority, as the government had alleged.

In May 2016, around the same time when Peterson was indicted, the SEC raised civil charges against Jaclin, Day, and ARTCO for compliance deficiencies, securities fraud, and filing false statements with the SEC. In the present, Jaclin's criminal; and civil cases remain pending in California; and on May 25, 2016, Christopher Day and ARTCO accepted responsibility for the SEC civil charges on securities fraud and filing false statements, which resulted in sanctions and a small fine- no imprisonment or extreme fines or restitution like the court ordered Peterson.

BERNIE'S ABUSE OF DUE PROCESS & DISCOVERY

U.S. Attorney Craig Carpenito and U.S. District Court Senior Judge Anne E. Thompson have denied the fact that the prior adjudication of the SEC administrative proceeding with Day and ARTCO for very similar securities fraud and false certification charges, and involving the same parties, actors incidents, entitles, and witnesses barred the prosecution against Peterson under law on 'collateral estoppel' and "res judicata."

Ironically, Deutsch told Center for Public Integrity that he was "not at all surprised" to hear about Peterson's arrest on the prior day. Later that same week, Deutsch told another media outlet, referred to as 'Rollcall' in court records, that filing a civil lawsuit or FEC complaint against Peterson's PAC would not be worthwhile or effective. In the same article, he stated that (contrary to court evidence, showing dialogue between Deutsch and Peterson) he "made it clear" that he wanted Peterson to cease all operations of the Sanders PAC, that was previously favoured by Sanders' administration prior to Sanders making his presidential in April 2015.

Also, the Rollcall.com article stated that he was happy to hear that the law finally "caught up" with Peterson. However, Peterson, who no prior criminal history was arrested in 2016 for non-political activities that occurred in 2012, related to a penny stock company, and foreign transactional projects with the United Nations and foreign governments. Court records show that Peterson began his pro-Sanders movement in 2014, when Peterson served as a regional coordinator for an independent political party- as Sen. Bernie Sanders, himself is an Indie Party politician who just so happened to make a presidential bid as a Democrat.

SANDERS' ATTORNEYS PAST TIES TO FCC & FEC RAISE QUESTIONS ON POSSIBLE MANIPULATION OF NEWS MEDIA & ELECTIONS

This extraordinary and cinematic legal web Peterson had compared to 90's movie Enemy of the State in a doctrine filed before his trial last year. Peterson alleged that Deutsch and Sanders used their political clout 'on The Hill' to manipulate the media and justice system, resulting in a trial-by-ambush that consisted of fourteen government witnesses who contrarily gave testimonies that helped to show Peterson's innocence more-than-less.

For example:

1. Trial court testimony from an EDGAR filing agency official attested that Peterson never filed any SEC filings, and he was never listed on the account as an authorized file.

2. In addition, two testimonies from two United Nations officials confirmed that Peterson had been involved with U.N. activities as a representative of a U.N. accredited organization; and the United Nations 'Grounds Pass' I.D. badge seized by the FBI during Peterson's arrest was authentic. (In addition, in November 2016, the judge verified supporting documents from the United Nations and granted an order allowing Peterson to travel to a U.N. event in New York while out on bail.

3. 2012 records for RVPlus, Inc. at Delaware Corporations Division show that only Christopher Day was the President, CEO, CFO, and Director.

HOW WAS PETERSON PROSECUTED WITH NO EVIDENCE OF FRAUD?

The U.S. Attorney had failed to present any evidence that Peterson was ever the CEO or any position of authority at the company. Gotcha documents stated that the evidence "res cips" ( meaning, 'it speaks for itself'). In fact, a transcript excerpt of Peterson's sentencing hearing was entered in the court of appeals last week, with a disclosure that no evidence of Peterson generating proceeds from fraud existed on court records.

Judge Thompson (85) also denied Peterson of his rights to a preliminary hearing, defence witnesses, and told his defence attorney at trial that he could not finish his closing 'summation' statements, yet allowed two assistant attorney generals to make opening and closing statements for close to two hours. Thus, Peterson, who did not testify at trial, himself, recently told the court of appeals that he spend two weeks in New Jersey in a jury trial that resembled a Cuban trial-by-ambush arranged by the infamous President Fidel Castro.

However, earlier this month Third Circuit Judge Restrepo granted Peterson's motion for 'prerogative writ', which ended the six-month holding pattern that deadlocked on Peterson's appeal case, possibilities of release from prison, and reversal of his sentence.

HOW DOES PETERSON'S TRIAL JUDGE IN CONNECTION WITH BERNIE SANDERS?

Peterson's "Breve Nominatum" (legal writ) filed with the Federal court in Portland, Oregon and the Third and Ninth Circuit U.S. courts disclosed that a third-degree relationship between the trial judge Thompson (whose maiden name is Jackson), a 31 year old relative (bearing her late husband's last name), who currently works for the same Delaware Democratic Party committee that she joined as a member in 1972 and is a political activist at a Delaware progressive political movement that aggressively supports Sen. Bernie Sanders may be part of the reason why Thompson had a personal conflict in his trial case that led to such egregious conduct. In addition, the judge's purported relative who Peterson referred to as "D.R.T."- (whose social media profile 'about me' section reads, "one word, politics. lol love it")- was a member of Peterson's pro-Sanders social media group before all of the negative controversies on Peterson's on-aeroplane arrest was published.

Peterson alleged that Judge Thompson gained knowledge of the personal connections to Peterson from Sanders, who Thompson had known of from civil rights movement activities in when they both lived in Chicago. Additionally the judge's pastor in Philadelphia (referred to as "J.M." in court documents), who lost $5,000 after buying RVPL stock in 2012.

Collectively, the fabricated claims of Peterson scamming 'James Bond', Sen. Bernie Sanders, and her pastor on top of the Fed claims is what triggered the deep-seated prejudice against him.

Whereas, neither any proof of scamming "007", Senator Bernie Sanders, or being CEO of the penny stock company (that allegedly burned her pastor) had ever been proven by the Department of Justice.

BERNIE SANDERS QUESTIONS FOR DNC DEBATE

More importantly, the court documents filed among the Gotcha Evidence included judicial notices on public interest, which raise questions substantial questions to how Bernie Sanders campaign fund attorney was compensated for all of his 'out-of-court' transactions that involve Peterson's private prosecution- that spiraled into what a reasonable person may consider political pandemonium, straight out of a Hollywood film.

Many news articles have implied that Bernie Sanders was using political donor campaign funds to finance his personal witchhunt on Peterson, as he had done to rent private jets and purchase holiday homes.

Tonight, at the Democratic presidential debate, the public, press, and other presidential candidates will have their opportunity to ask Sanders his political views on criminal justice, public safety, and constitutional rights and liberties for minorities- and possibly (but highly unlikely) get Sanders' feedback on the Gotcha Evidence- a vivid display unsound and tortious acts of an anarchy that tied up courts, and donor and tax dollars for ultrahazardous activity at unreasonable risks for personal matters), that have the likelihood to substantially disserve the public in more ways than one.
